CITY OF KANKAKEE

CITY COUNCIL MEETING

   JULY 21, 2008       7:02 P.M.

 

MAYOR GREEN:       I’d like to call the meeting to order, please.  I’d like to ask Pastor Larry Garcia from the New Life Pentecostal Church to come up and open our meeting with a prayer.

 

PASTOR GARCIA:     If we may bow our heads and let us pray.  Jesus, our Lord and Savior, we stand here in awe of You, united and in unison lifting one voice.  God, we acknowledge You and who You are, for You are the creator of all things, Lord.  You are the Lord of all.  You are our protector.  You are our provider.  You are our healer and our deliverer and our redeemer.  We thank You for the power that You have given us because of the blood that You shed on Calvary.  We come before You in Your presence, humbly and undeserving.  But, Your grace is sufficient.  We acknowledge Your mercy upon us.  We thank You for this day that You have given us and Jesus, we come to You this time not asking or complaining, but to thank You, Lord, for we are not an ungrateful people.  For we thank You for our nation, Lord, we thank You for our government, we thank You for our military that is protecting us.  We thank You for our State government and our County government.  And, Lord, we thank You for this City, Lord, and the things that You provide.  We thank You for the Mayor, the City Attorney, all the City employees, the Aldermen, the Police and the Firemen and the public workers.  We thank You for all of this.  And, Lord, together in one voice, we thank You for You and Your word and for what You’ve given us.  And, Lord, we close this prayer and understanding if my people which are called by my name, shall humble themselves and pray and seek my face and turn from their wicked ways, then will I hear from heaven.  They will forgive their sins.  They will heal their land.  Thank You, Jesus for Your word that will guide us in this life and in Jesus’ name we pray.  Amen.

Tedmark.

We will have the new budget for the City for the upcoming year.  If it reports favorably out of the Committee, then we will refer it to City Council at the August 4, meeting.  New Business.  We have a handicapped parking, 152 S. Oakdale Avenue.

ORDINANCE AMENDING CHAPTER 32, SECTION 231 ESTABLISHING A

HANDICAPPED PARKING SIGN AT 152 SOUTH OAKDALE AVENUE

 

MAYOR GREEN:       Motion carries.  Next, is a Change Order.  This is for the asbestos removal at the old City Hall building.  We had already approved the contract, but when they got into the building to remove the asbestos, there was a little more than what they anticipated so there is a Change Order for $6,800.00.  It isn’t something we couldn’t do.  We have to do it.  So, we’re asking for your approval of this Change Order.

ORDINANCE AMENDING CHAPTER 8 (BUILDING AND BUILDING REGULATIONS)

OF THE KANKAKEE MUNICIPAL CODE, AS AMENDED

 

MAYOR GREEN:       Motion carries.  Next, is an Ordinance amending Chapter 8, the building and building regulations of the Kankakee Municipal Code as amended by adding article for contractor’s license. 

 

ALDERMAN HUNTER:         Before, Mayor Green, I know that there may be a motion to approve this particular Ordinance.  But, I would ask for a raise of hands for all the Aldermen who can cite or state what this Ordinance provides.  I know that there’s going to be a statement indicating that you received a copy of this a month ago.  Can anybody.........can I see a raise of hands of the people who can tell me what this is all about?  Can I see a raise the hands of anybody who can tell me what this Ordinance is all about?  Heard also that maybe this particular Ordinance that you’re considering here tonight maybe needs to be consistent with what Bradley and Bourbonnais provide.  Now, is this consistent with what Bradley and Bourbonnais provide?

ALDERMAN HUNTER:         Okay.  Is that a correct statement, Alderman Baron?

 

ALDERMAN BARON:           We had a little table talk here before the session.

 

ALDERMAN HUNTER:         What I’m merely asking for is if this particular matter could be held up–I’m not saying Tabled or anything, just asking for some due consideration for you guys to review this material again and come forward.  I didn’t raise any saying about the previous because I think all of us concurred with the fees, etc., and so forth, I think.  The Chairman of the Committee shepherded that legislation through the Committee after some period of time.  This particular piece of legislation I have some concerns about in terms of compliance.  And how it will be used and arbitrary indistinguishable.  That’s why I’m asking for you to, again, put your hands on the document, review it in totality, bring back some concerns and questions that you may have and not vote blindly on a piece of information or Ordinance that’s, ah, presented to the Council.   I don’t think any of you guys are rubber stamps for anything that’s brought before the City Council and I know that you are all individuals and you vote your own minds.  I would hope and pray, looking at all of you it appears that you’re of that particular mindset.

ALDERMAN WILLIAMS:     Mayor Green, ah, I’m not on that Committee, but did this go through the Ordinance Committee?  Did they discuss it?

 

MAYOR GREEN:       I think it went through the Code Committee.

 

ALDERMAN EPSTEIN:         This went through the Code and Planning.

 

ALDERMAN WILLIAMS:     Yeah, right.  I remember it went to the Code, but did it go through....... did it have to go through an Ordinance Committee?

 

MAYOR GREEN:       You can bring it up from that Committee.  You can report it out to the Floor.  Can I........

 

ALDERMAN EPSTEIN:         May I make a motion that we put this on its First Reading tonight?

 

MAYOR GREEN:       Yes, you can.  You can do anything.  Is there a second?

 

ALDERMAN GRANT:           I’ll second it, but before indistinguishable I wanted Alderman Diersen to tell you what happened at the Ordinance meeting that was referred to.

 

MAYOR GREEN:       Well, we’ve got a motion to put it on its First Reading and a second.  Now we’re open for comments.  Alderman Diersen.

 

ALDERMAN DIERSEN:        Yes, I would just like to make a comment that, ah, Mr. Shaw did come to an Ordinance meeting a month or so ago to present this and because of a lack of quorum, which we always have, nothing was done about it.

 

MAYOR GREEN:       Okay.

 

ALDERMAN HUNTER:         Again, I would ask for a raise of hands for those of you who understand what the implications are of this document here–this Ordinance.  There’s been a motion to place this on First Reading.  And, I would ask for those of you who are on this Council, to tell me what this Ordinance provides for.

 

MAYOR GREEN:       There’s a motion and a second on the Floor.  Ah, any other comments?  Alderman Jones.

 

ALDERMAN JONES:             Mayor, those Ordinance meetings that I missed due to work, ah, the last two including tomorrow night’s Ordinance meeting, when I schedule myself off gets canceled.  The night that I had to work and I apologize for not making that Ordinance meeting, was the night that, I guess, this was brought up and I was not in attendance.  I would like it to go back to Ordinance Committee so we can discuss this in Ordinance Committee if at all possible.  Since there was no quorum that night.

 

MAYOR GREEN:       Any other comments? 

 

ALDERMAN HUNTER:         Let me say this.  I’m going to ask again.  Now, I mentioned to you that I wasn’t necessarily for Tabling this matter.  I was just asking for some due consideration of.......for all 13 Aldermen who are here this evening to please tell me what this Ordinance provides for.  I haven’t heard anybody say anything other than it’s a contractors’ license indistinguishable .  But, I would ask you guys to wait some appropriate period of time, get your hands on that document and read it and ask Mr. Shaw what the ramifications and what the implications are of this document.  If that’s not........if that’s not going to be done, maybe this matter could be Tabled.  And, that’s not something I want to do.  At least make the motion.  But if, indeed,  it is called for a vote on the First Reading, I would ask you to be inclined to vote against this at this time.

 

MAYOR GREEN:       Can the Chair make a suggestion?  This.......we have kicked around the Ordinance of a Contractor’s Licensing Ordinance probably for the last five years.  Ah, there is a motion and a second to put this on its First Reading.  I think Alderman Hunter’s suggestion was correct in the very beginning.  I think if we........if we take any action on this that doesn’t mean that it will necessarily pass on the Second Reading.  But, I think it would behoove us to get it out on the Table, send this Ordinance to the Village of Bradley and the Village of Bourbonnais and say this is what we’re looking at.  Is this the same as you have in place?  Or where are the differences in the Ordinance?  Because I think that’s been the issue every time we have sat down in joint meetings with our neighboring communities, that we all want to be doing the same thing.  Because it becomes detrimental to any one community if it’s that dramatically different from the other communities.  So, that is a suggestion.  If you don’t feel comfortable doing that we can, you know.........and my office will see that it is sent to the other two municipalities.

 

ALDERMAN HUNTER:         Therefore, then, would the maker and the seconder rescind their actions?

MAYOR GREEN:       Alderman, I don’t think.  They’re not going to raise their hands and answer that question.  I think.........I still think we should just vote on it.  Put it on its First Reading only and then send it out.

ALDERMAN HUNTER:         Let........let me.........with all due respect, Mayor Green, I’m just merely asking for a response of these elected officials here.  All twelve, other than myself, who are going to vote on this here and tell me what this provides for.  If nobody can tell me what it provides for, what it does, what the implications are, why should we even vote on it?  I don’t think they’re blindly voting for this particular.....this piece of legislation.  That’s what I’m asking for.  If nobody cares to respond, it’s either they know what it provides for and they’re afraid to do so or articulate what it provides for or they don’t know.

ALDERMAN DIERSEN:        We have hired an individual in the capacity to overlook something like this.  I think he’s come up with a proposal and I think we should vote on it and I call the question.

MAYOR GREEN:       Motion carries.  Next, is an Ordinance declaring certain property surplus.  I had mentioned to you that Mayor Peyton had called me from the Village of Hopkins Park that when we moved out of City Hall, if there was any furniture, he’d like to.........certainly would like to look at it.  I did that with him last week.  Ah, he’s made a selection of some items.  It’s not a large selection.  It’s just some things that they can use in their City Hall.  We’d certainly recommend that we declare this surplus and allow us to give it to the Village at no cost.  They will come and pick it up.

MAYOR GREEN:       Motion carries.  Next, there are no Appointments.  Under Motions and Resolutions, we’ve got a Resolution honoring Doctor Pastor Ella Mae Davis.  Is there a motion?

RESOLUTION HONORING PASTOR DOCTOR ELLA MAE DAVIS

 

MAYOR GREEN:       Motion carries.  Next, is a Resolution in the amount of $65,000.00 for the 2008 Motor Fuel Tax Maintenance Program.  And, Mr. Tyson, what’s the reason?  You told me and I’ve forgotten already. 

 

DAVID TYSON:         The reason was the bids came in for our program two weeks ago.  They were higher than the original estimate.  This Resolution is just to cover the difference of what the bid was and the original estimate.

 

MAYOR GREEN:       So, we need a..........

MAYOR GREEN:       Motion carries.  There is no reason for an Executive Session.   Is there........are there any Aldermanic comments?  Then, what I’d like to ask you to do, if you’ll please, is let’s recess–if I could just have your attention for a minute, please–let’s recess this meeting because I’m going to ask you to reconvene at the new Administration Building at 304 S. Indiana.  I’m doing that so we’re in compliance with the Open Meetings Act.  And, then we can recess this meeting from there.  What we’d like to do is take you, the Aldermen, and actually anybody in the audience that wants to go through the facility.  We want to show you your facilities that you have and it will give us the opportunity to do it.  Pete Schiel is here and he’s........if you so desire....he’s got a short presentation–a Power Point presentation on the building.  I think you will find it quite interesting.  So, I’d like for a motion to recess this meeting.
